ASBESTOS & MESOTHELIOMA

Once a popular industrial and consumer product, asbestos is recognized today as a potent carcinogen. For many years after the danger was known, companies whose business depended on asbestos tried to hide the truth or failed to adequately protect their workers from harm. Today, many of these innocent people suffer from mesothelioma, lung cancer, and other illnesses linked to asbestos. Our attorneys have recovered millions of dollars for families whose loved ones contracted an asbestos-related disease.

CONSTRUCTION site ACCIDENTS

Construction workers face some of the highest risks of any group of professionals in the United States. An unsafe worksite is an accident waiting to happen. Injuries may occur as a result of the negligence of a general contractor, subcontractor, or other party. If you have been injured in a construction accident through no fault of your own, you may be entitled to a large settlement covering your lost wages, disability, pain and suffering, permanent harm, and other losses.

WRONGFUL DEATH

There are many scenarios in which a person's negligent conduct can contribute to the death of another. Wrongful deaths most often take place in motor vehicle accidents, construction accidents and other workplace mishaps, as a result of defective products, and due to medical malpractice. Anyone who loses an immediate family member to wrongful death can file a lawsuit. Potential damages may include losses of family income, companionship, inheritance, benefits, conscious pain and suffering, mental anguish, funeral and other death expenses, and medical bills. Additionally, Massachusetts law allows for punitive damages in cases of egregious wrongdoing, such as when the death is intentional or the result of extreme recklessness.

CHILDREN’S INJURIES

In most instances, in Massachusetts, a child who is injured as a result of the negligence of another has until he or she reaches the age of majority to file a lawsuit to preserve his or her case. This extra time is important since consequences of a significant injury may appear much later on after the child has developed. At Rodman, Rodman & Sandman, our attorneys have resolved hundreds of injury cases involving minors from dog bites and burns to falls and injuries from machinery. In each case, our sole focus is on the health and welfare of the child. We work with families to obtain court approval of the minor’s settlement and we help to secure the settlement funds by entering into structured settlements paying the child well into the future. We also assist in setting up trust accounts in the minor’s name.

MOTOR VEHICLE ACCIDENTS

Millions of motor vehicle accidents occur in the United States each year, resulting in many thousands of serious injuries and wrongful deaths. In addition to auto, motorcycle, pedestrian and truck accident cases, the lawyers at Rodman, Rodman & Sandman handle specialized lawsuits for victims of train accidents and other complex crashes. We are knowledgeable in all aspects of motor vehicle insurance coverage and the applicability of motor vehicle insurance policies to the particular circumstances of each accident.

environmental & TOXIC TORTS

Toxic substances put ordinary people at risk every day. From industrial chemical leaks to tobacco and asbestos, these substances cause chronic illness, birth defects, and premature death. Our personal injury lawyers have been instrumental in groundbreaking tobacco, asbestos, and water contamination litigations. Currently our firm is local counsel for over 100 cities and towns in Massachusetts in the National Prescription Opiate Litigation.

WORKERS’ COMPENSATION

In Massachusetts, employers are required to carry workers’ compensation insurance on behalf of their employees. Injuries that occur during the course of one’s employment, regardless of fault, are compensable under the Workers’ Compensation Act so long as the employee establishes disability from employment through medical evidence. The attorneys at Rodman, Rodman & Sandman have successfully represented hundreds of workers at Hearings and Conferences at the Department of Industrial Accidents for an array of work-related injuries including motor vehicle accidents on the job, occupational exposure to asbestos, trip and fall accidents, and injuries caused by heavy machinery. We have fought to get workers on compensation benefits, keep them on benefits, and, if appropriate, negotiate equitable lump sum settlements on their behalf.

PRODUCT DEFECT CLAIMS

Poorly designed and manufactured products pose a significant hazard to consumers. Dangerous product defects regularly cause injuries, illnesses, and even deaths. Some examples of defective product claims include Defective Drugs and Medical Devices, Crashworthiness and Defective Automobiles, Defective Children's Products, and Defective Machinery and Equipment. In these cases, liability may rest with manufacturers, distributors, or other entities, and our lawyers will work diligently to ensure that redress is pursued against all potentially liable parties.

Premises Liability

The owners and managers of property, both public and private, have an obligation to maintain reasonably safe premises to protect visitors from injury. If you have been injured by a hazard of any kind on someone else's property, you may have a premises liability case. These cases may include trip and fall accidents, dog bites, injuries from negligent security at a place of business, injuries from falling objects, and many more.

MEDICAL MALPRACTICE

Medical malpractice occurs when health care providers give care that fails to meet accepted standards for quality. Surgical errors, nursing home abuse, failure to diagnose, and other forms of malpractice have dire consequences for the unlucky victims. Contact our personal injury lawyers to learn if you or a family member has a viable claim for Medical Malpractice.

Traumatic Brain injuries

A debilitating head injury has devastating consequences, both for victims and their friends and families. One may sustain trauma to the brain in several different ways including motor vehicle accidents, slip and falls, construction site accidents or from falling debris. The level of a traumatic brain injury (TBI) may vary greatly in terms of the degree of resulting cognitive impairment. Brain injuries typically involve striking of the head, producing post-concussive symptoms. However, in some instances, such as with electric shock, chemical exposure, or even severe whiplash, significant injury to the brain may still occur even without a striking of the head. The attorneys at Rodman, Rodman & Sandman have vast experience in working with neurologists and neuropsychologists to understand the mechanisms and consequences of traumatic brain injuries. This experience has greatly assisted our attorneys in obtaining substantial settlements on behalf of their clients.
